The incumbent provides support to Air Canada's Workplace Practices and Investigations Office in handling workplace violence and harassment cases through fair, timely, impartial, and effective investigation and resolution processes. Reporting to the Director – Workplace Practices and Investigations – North America, the person in this position manages low to moderate complexity workplace investigations, facilitates negotiated settlement and conciliation processes, supports intake and case management functions, assists senior investigators with complex, sensitive, or high-risk issues, and contributes to education, awareness, and workplace violence and harassment prevention initiatives.
Responsibilities:
Investigation Functions
Investigation Planning and Assessment
- Review incident notices and available information to determine issues requiring investigation, then develop an appropriate investigation plan.
- Determine relevant evidence sources, identify evidence gaps, scope considerations, and potential risks, and escalate appropriately.
- Conduct investigations within the approved mandate and maintain an appropriate investigation scope.
Fact-Finding and Evidence Collection
- Conduct low to moderate complexity workplace investigations in accordance with Workplace Practices and Investigations Office procedures, principles of procedural fairness, and investigative best practices.
- Interview primary parties, respondents, witnesses, and other relevant individuals using effective, neutral, and trauma-informed interview techniques.
- Gather, review, organize, and evaluate probative, documentary, electronic, physical, and other evidence.
- Determine inconsistencies, corroboration, evidence gaps, and areas requiring further review.
- Ensure parties have the opportunity to respond to relevant information when required by the investigation process.
- Support senior investigators on complex, sensitive, high-risk, or highly visible issues as needed.
Analysis and Findings
- Analyze and synthesize evidence to determine important facts, assess credibility and reliability, and draw conclusions based on the totality of evidence.
- Prepare timelines, evidence summaries, and other analytical tools to support investigations.
- Make objective, evidence-based findings in accordance with the standard of the preponderance of probabilities.
- Identify significant evidence gaps and seek assistance from senior investigators as needed.
Reporting and Case Management
- Draft clear, objective, and well-supported investigation reports.
- Maintain complete, accurate, confidential, and defensible case files in the Workplace Practices and Investigations Office case management system.
- Proactively manage assigned investigations, document key investigative activities and decisions, and adhere to established deadlines and milestones.
- Participate in quality assurance processes and incorporate feedback to support continuous improvement.
- Escalate issues that could compromise the fairness, effectiveness, and timeliness of the investigation.
Intake and Resolution Functions
- Receive and respond to incident notices and other concerns related to workplace violence and harassment.
- Provide clear, accurate, neutral, and accessible information on available resolution options and processes.
- Facilitate negotiated settlements and conciliation in accordance with Workplace Practices and Investigations Office procedures and established role boundaries.
- Maintain appropriate boundaries between investigative, resolution, and advisory functions while preserving the neutrality and independence of the Workplace Practices and Investigations Office.
- Identify and escalate issues concerning safety risks, retaliation risks, conflicts of interest, significant power imbalances, or other factors likely to compromise process integrity.
- Collaborate with managers, Human Resources, Labor Relations, union representatives, joint health and safety committees, and other stakeholders as appropriate while respecting confidentiality, neutrality, impartiality, and independence.
Case Management and Prevention Initiatives
- Maintain accurate, complete, and up-to-date case files in the Workplace Practices and Investigations Office case management system.
- Monitor assigned files while respecting established deadlines and milestones, and proactively support file progression.
- Support data collection, file tracking, trend analysis, and reporting to inform prevention and continuous improvement initiatives.
- Identify emerging trends, risks, and opportunities to support workplace awareness and prevention, as well as culture enhancement.
- Participate in workplace violence and harassment education, awareness, training, and prevention initiatives.
- Support workplace climate assessments and other prevention activities as needed.
- Participate in team meetings, case consultations, peer learning, and professional development activities.
- Contribute to special projects and other Workplace Practices and Investigations Office initiatives as assigned.
Qualifications
- At least three years of relevant experience in investigations, complaint handling, employee relations, workplace conflict resolution, mediation, labor relations, human resources, law, or a related field.
- Degree in law, paralegal studies, labor relations, industrial relations, human resources, or another relevant discipline.
- Fluency in English and French (oral and written).
- Training or experience in trauma-informed interview techniques, workplace violence and harassment investigations, or related investigative methods.
- Demonstrated ability to analyze and synthesize testimony, documents, electronic communications, and other evidence, including determining the relevance of facts, inconsistencies, corroboration, and evidence gaps.
- Demonstrated investigative judgment and the ability to distinguish important information from minor details, determine if further investigation is necessary, recognize the limits of one's mandate or expertise, and escalate complex or sensitive issues as needed.
- Interview and interpersonal skills, including the ability to build rapport, ask appropriate probing and effective questions, manage difficult conversations, and interact professionally with individuals dealing with sensitive or highly conflicting situations.
- Demonstrated understanding and ability to apply principles of procedural fairness, neutrality, impartiality, confidentiality, and objective decision-making.
- Knowledge of the Canada Labour Code, the Work Place Harassment and Violence Prevention Regulations, the Canadian Human Rights Act, and any other relevant workplace legislation, or demonstrated ability to rapidly acquire and apply such knowledge.
- Proven ability to write organized, objective, concise, and reasoned reports, as well as professional correspondence.
- Demonstrated ability to handle highly sensitive information—whether personal, medical, labor relations, or workplace related—with discretion, judgment, and strict confidentiality.
- Excellent organizational, communication, and time management skills, and the ability to manage multiple files simultaneously, prioritize competing demands, meet established deadlines, and proactively identify barriers to timely completion.
- Collaboration skills and demonstrated ability to contribute effectively within a multidisciplinary team while maintaining independence.
- Ability to receive, integrate, and apply feedback arising from coaching, quality assurance, and professional development activities.
Assets
- Experience using Microsoft Copilot or other approved productivity technologies.
- Experience in the airline or transportation industry.
- Training in workplace investigations or a recognized investigation certificate.
- Training or experience in trauma-informed interview techniques, workplace violence and harassment investigations, or related investigative methods.
- Training, accreditation, or certification in mediation.
- Experience conducting legal, legislative, regulatory, jurisprudential, or policy-related research, and applying findings to workplace issues.
- Experience in a unionized or federally regulated workplace.
- Experience supporting arbitration, grievance, administrative procedure, or other decision-making processes.
- Experience managing sensitive, highly conflicting, or complex workplace situations.
- Experience conducting workplace climate assessments.
- Experience implementing workplace training, awareness, or prevention initiatives.
